Terms of service

Worth Terms of Service & Electronic Communications Agreement

Important: By accessing and using Worth Services, you agree to these Terms of Service, our Privacy Policy, and any applicable Additional Terms. This Agreement affects your legal rights, including an agreement to resolve disputes through binding arbitration with a class action waiver.

Worth Financial Inc. ("Worth," "we," "us," or "our") operates an integrated financial platform that combines banking, wireless telecommunications, and credit services under the tagline "Banking + Wireless + Credit." We believe your character matters more than your credit history, and we've built the first platform that recognizes and rewards reliable behavior across all aspects of your financial life.

"Services" means all products and services owned and operated by Worth Financial Inc., including the content, features, tools, data, software and functions made available through our website, the Worth mobile applications, and other platforms we operate.

Your digital-first experience

To deliver your integrated banking, wireless, and credit services instantly and securely, Worth provides all communications, documents, and services electronically. This enables us to:

  • Notify you immediately of account activity across all services
  • Process credit applications and approvals in real-time
  • Activate wireless services without delays
  • Provide integrated financial insights and Trust Score updates
  • Deliver seamless customer support across all service lines

Delivery methods

We may deliver electronic communications through:

  • Email to your registered email address
  • Text messages to your registered mobile phone number
  • In-app notifications through the Worth mobile application
  • Secure messages within your online account dashboard
  • Push notifications on your mobile device

Standard messaging rates may apply for SMS communications. You may opt out of promotional messages but cannot opt out of service-related communications while maintaining active services.

Technical requirements

To access and retain electronic documents, you need:

  • A device with internet connectivity
  • An updated web browser that supports HTTPS and HTML5
  • Ability to receive and open PDF documents
  • Email account capable of receiving messages from Worth
  • Sufficient storage space or printing capability to retain important documents

General requirements

To use the Services you must:

  • Be at least eighteen (18) years old and able to form legally binding contracts
  • Have not previously been suspended or removed from the Services
  • Register for and use the Services in compliance with all applicable laws and regulations

Account registration

When you register for an account, we will ask you to provide identifying information including your email address, phone number, personal information, and to create a unique username and password. You agree to provide true, accurate, current, and complete information about yourself.

Account security

You are solely responsible for maintaining the confidentiality and security of your Account Information. You must keep your password confidential and may not share it. You are responsible for all activities that occur under your account. If you believe your account has been compromised, immediately notify customer support.

USA PATRIOT Act compliance

Section 326 of the USA PATRIOT Act requires all financial institutions to obtain, verify, and record information that identifies each person who opens an account. To comply, Worth will:

  • Ask for your name, address, date of birth, and other identifying information
  • Request to see your driver's license or identification card
  • Verify your identity through third-party databases
  • Determine whether you appear on any lists of known or suspected terrorists

Credit reporting authorization

By registering an account, you provide written instructions in accordance with the Fair Credit Reporting Act for Worth to periodically request and receive consumer reports, scores and other information about you from TransUnion, Experian, and Equifax. This information will be used to calculate your Trust Score, provide character-based financial services recommendations, and offer integrated products.

Service fees

Worth operates on a transparent, value-based fee structure. Certain Services include a monthly service fee of $35 ("Service Fee") that covers your integrated banking, wireless, and credit services. Payment in US dollars is due monthly and will be automatically processed.

Payment processing

By providing a payment method, you authorize us to charge all fees to that payment method. If your payment method fails, we may try alternative payment methods you have on file. We may suspend or terminate your Services if payment is not received.

Refunds

Refunds are provided at Worth's discretion. Any refunds will be credited to your original payment method within 5-10 business days. Wireless service fees are generally non-refundable once service has been activated.

Banking services

Worth Banking Services are provided in partnership with Cross River Bank, Member FDIC. Your deposits are FDIC-insured up to $250,000 per depositor. Additional terms governing banking services are provided in the Deposit Account Agreement.

Wireless services

Worth Wireless Services are provided through our partnerships with major wireless carriers. Service availability, speeds, and coverage may vary by location. Wireless services are subject to our Wireless Service Terms and acceptable use policies.

Credit services

Worth Credit Services include character-based lending products. Loan approval, amounts, and terms are based on your Trust Score and other factors. Credit services are subject to additional loan agreements and disclosures.

Trust Score

The Worth Trust Score is our proprietary assessment of your financial character. It is calculated using behavioral data from your use of Worth services, including payment history, account management, and service usage patterns. Your Trust Score may affect your eligibility for certain products and services.

Worth may offer community features that allow you to interact with other users. When using community features, you agree to:

  • Not post content that is harmful, threatening, abusive, or harassing
  • Not impersonate others or misrepresent your affiliation with any person or entity
  • Not post spam, chain letters, or pyramid schemes
  • Not violate any applicable laws or regulations
  • Not interfere with or disrupt the Services

Worth reserves the right to remove any content and suspend or terminate accounts that violate these rules.

The Services and all content, features, and functionality are owned by Worth Financial Inc. and are protected by copyright, trademark, patent, trade secret, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Services without our prior written consent.

"Worth," the Worth logo, "Trust Score," and other marks are trademarks of Worth Financial Inc. You may not use these marks without our prior written permission.

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Services will be uninterrupted, timely, secure, or error-free. We do not warrant that the results obtained from use of the Services will be accurate or reliable.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WORTH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Our total liability for any claims arising from or relating to these Terms or the Services shall not exceed the amounts you have paid to Worth in the twelve (12) months preceding the claim.

You agree to indemnify, defend, and hold harmless Worth Financial Inc., its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your access to or use of the Services or your violation of these Terms.

Binding arbitration agreement

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

You and Worth agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Services shall be resolved through binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify.

Class action waiver

YOU AND WORTH AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

Arbitration rules

Arbitration will be conducted by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will be held in the county where you reside or at another mutually agreed location.

Opt-out

You may opt out of this arbitration agreement by sending written notice to Worth within 30 days of first accepting these Terms. Your notice must include your name, address, and a clear statement that you wish to opt out of arbitration.

Governing law

These Terms shall be governed by the laws of the State of Delaware, without regard to its conflict of laws principles.

Entire agreement

These Terms constitute the entire agreement between you and Worth regarding the Services and supersede all prior agreements and understandings.

Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

Waiver

Our failure to enforce any right or provision of these Terms shall not be considered a waiver of those rights.

Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.
